DUI: DUI Defense Overview

DUI defense is critical to dealing with an arrest for driving under the influence. No question: you need to schedule a conference with a lawyer. Here is some insight into DUI defense:

DUI Defense, II
by Eddie Tobey

DUI defense is regarded as a highly specialized area of law, as it involves a series of scientific procedures including field sobriety tests. DUI cases are very complex and call for tremendous attorney expertise. Driving under the influence (DUI) legally refers to a serious offence caused by drunk driving. Its consequences are severe and may lead to punishments, penalties and stiff fines. Depending upon the nature and jurisdictions, DUI is known by different names such as driving while intoxicated (DWI), operating motor vehicle intoxicated (OMVI), operation under the influence (OUI) and operating while intoxicated (OWI).
Editor's note: States have been lowering the blood alcohol standard from 0.10 to 0.08 as the point at which you are legally drunk.
DUI defense lawyers have to be armed with specific scientific as well as legal knowledge. DUI defense requires the defending counsel to also have a practical awareness of the operation of breath test equipment, hospital testing equipment and instruments utilized by forensic laboratories in the process of testing for intoxicants. A competent and qualified lawyer is aware of all kinds of loopholes, and has the ability to suppress evidence and produce good witnesses.
Editor's note: An important part of DUI case preparation centers around discovery of factual information in the hands of the State.
Another point to remember in DUI defense is that the laws pertaining to driving under the influence are complicated and differ from state to state. However, the statutes of all states have the common purpose of punishing driving under the influence of intoxicated substances. Punishments for driving under the influence have become severe in recent years. There is a good chance that there could be a restriction of license privileges for a stipulated period, mandatory minimum jail, and probation and vehicle forfeiture.

DUI: You Need a DUI Lawyer Now!

DUI, or driving under the influence, is a criminal offense that must be defended vigorously. If you have been charged with DUI, then you need to talk to a lawyer -- now!

Here is some overview information for you to consider:

---------------

DUI Defense
By Eddie Tobey

There are several defenses available to people who are accused of driving under the influence. Since the prosecution has the burden of proving each and every element of the case beyond a reasonable doubt, the defendant need only create reasonable doubt in one area in order to prevail against a drunk driving charge.

A person is not necessarily guilty if the machine says he is above the legal limit. There are many defenses to DUI or DWI cases, and these should be explored before even considering pleading guilty to DUI or a related drunk-driving offense.

It is usually legal to drink and drive, but if the driver is under the influence then it becomes illegal. In different states, under the influence is defined differently, but generally it refers to those cases in which the driver is drunk or has taken drugs to such an extent that that his mental and physical abilities are impaired and they no longer have the ability to operate the vehicle with the caution characteristic of a sober person under the same or similar circumstances.

Defense to the criminal charges may arise from different areas, and consultation with a DUI defense lawyer is critical to determine which may apply in a given case.

Other defenses relate to the reliability of the chemical test results. Some people, for example, are simply not suitable candidates for breath testing due to dental problems, which trap alcohol in the mouth and create falsely high breath test results. Others suffer from medical conditions such as persistent heartburn (GERD), which can cause falsely high readings in breath tests. It takes between a millionth and a billionth of a fluid ounce of alcohol to register a .10 on the breath test machines. This is above the legal limit in every state, and can result in a criminal conviction unless fully explored by a qualified DUI or DWI defense lawyer.
